This Friday, Cédric Jubillar was taken from the Seysses remand center, where he has been incarcerated for more than a year, to spend an hour and a half in the office of the examining magistrates, at the Toulouse courthouse. The two magistrates are trying to find out what happened the night of December 15 to 16, 2020, at the couple’s marital home, in Cagnac-les-Mines, in the Tarn. Since June 18, 2021, this 35-year-old plasterer has indeed been indicted for the murder of his wife, Delphine, who disappeared that December night.
As part of this case, several beats took place to find the body of the nurse, dozens of expert reports were carried out and significant resources deployed to try to shed light on the circumstances of this disappearance. Quickly, the investigators of the research section of the gendarmerie forged the conviction that Cédric Jubillar was responsible for the death of his wife.
According to recent analyzes of the telephone network, the phone of this mother, never found, would not have left the housing estate where the couple lived. He might even have stayed inside the house. An element which would corroborate the thesis of the accusation, of a violent argument within the couple which would have ended in the death of the young woman. For defense lawyers, this study of telephone networks is far from reliable. This is what they repeated this Friday before the judges, in the presence of their client.
Expertise castigated by defense lawyers
“It lasted 1h30, the judges have no questions, they are unable to oppose him with evidence, we go around in circles, it’s always the same thing. An interrogation which brought nothing ”, reacted Alexandre Martin, one of the three defenders of Cédric Jubillar, when he left.
“On the glasses, we have an expertise which shows that if we exert pressure from the outside inwards, they break… Knowing that they were broken before. The second expertise which says that the telephone is locatable, it does not hold water. The architecture of the networks has since changed and at 6:52 a.m. Cédric Jubillar was with the gendarmes at home, he called X times Delphine in front of the gendarmes that morning. We must now return to criminology,” continues the criminal lawyer.
For the defenders of the plasterer, their client continued to claim his innocence before the investigating judges. And now, they plead for a reconstruction of that night, under the same conditions.
“The reconstruction, we asked, it would be good at some point for someone to explain to us what they are reproaching us for very precisely: these are the cries heard by the neighbors, so it would have happened outside? It is the scene described by the child, therefore in the house. Is it the blue car, the white car? It’s a stabbing according to the fellow inmate, is it a strangulation? At some point we would like to be opposed to a thesis, truths, certainties on which we can defend ourselves. We will ask the prosecution, show us, what is your thesis, explain to us what happened, ”continues Me Martin.
In the meantime, they are waiting to be able to defend their client’s request for release before the investigating chamber again, in particular his placement under an electronic bracelet.
