Order of advocats. Mixed election for the future president Yves Hartemann

Yves Hartemann, 59, was elected future president of the Lyon Bar Association, alongside Valérie Giet, vice-president. The two lawyers must take office on 1er January 2024, for two years. The two candidates were alone in the running, which is extremely rare. The ballot on Monday November 14 and Tuesday November 15, however, counted less than 2,000 voters out of nearly 4,000 lawyers registered with the bar, a historically low level. In its press release without figures, the bar recalled the role of ordinal elected officials, “guarantors of ethics and discipline”. However, this single candidacy is debated within the bar.

Yves Hartemann is indeed cited in a thorny case of industrial pollution in Grézieu-la-Varenne (Rhône), of which he was mayor from 1995 to 2008. Constructions, on land of the former industrial laundry in question, have had place after modification of the land use plan, under his mandate. However, the lawyer was married to the industrialist’s daughter, and his partner was married to a notary involved in land sales.

Ongoing proceedings

Several ongoing civil proceedings are asking for substantial reparations. Two subpoenas, relocated to the Saint-Étienne court, have directly targeted Mr. Hartemann since September, one personally, the other for his participation in an SCI (civil real estate company, editor’s note) family.

Another criminal procedure is instructed in Marseille for “ecocide and fraud in an organized gang”, in which the future chairman is not cited today. The judges wonder about the history of pollution and the conditions of sale of land and houses in polluted areas. At this stage, no indictment is made.


However, aware of the risk of hearing the former mayor in this case, several members of the bar association have tried to convince him to withdraw his candidacy, or at least to delay it. He refused, after a discreet meeting at the Maison des Avocats at the end of October. “There is no other object than a perfectly legitimate election, the rest is elucubration. No procedure concerns me”says Yves Hartemann to Grandstand of Lyonabout the instruction of Marseilles.

“Civil actions can be brought against anyone, this has nothing to do with the status of president, for which I was appointed for my 35-year career as a lawyer, and thus largely legitimized”, he adds.

The man sees pure slander in his questioning. He prefers to evoke his baton, to respond to the “concerns of young lawyers who do not recognize themselves in the status of collaborator, to whom we must restore confidence”. The future chairman still intends to defend the “radiance of lawyers and the Bar of Lyon”.

Criminal and politician

Penalist, specialist in bodily injury, Yves Hartemann displays an undeniable professional success. Recently, he participated as a civil party in the trial of the Nice attack, in Paris.

Parallel to his career as a lawyer, he carried out political activities, rather located on the center left. He was approached for a municipal candidacy in Lyon in 2008, without follow-up. His recent attempt at Charbonnières-les-Bains was no more successful.
