Jubillar case: Cédric’s lawyer “did not receive a summons” for a reconstitution

Request for release, reconstitution… Cédric Jubillar’s lawyer, Me Jean-Baptiste Alary, reacts.

The investigating chamber must rule on Tuesday on a sixth request for release. Do you believe in a favorable response?

We would like to finally be heard and that the file can receive a different treatment than that which has been reserved for it since the beginning of the case.

Why did your previous request to place Cédric Jubillar on an electronic bracelet fail?

It got stuck because the prison integration and probation service (Spip), either out of confounding bad faith or gross incompetence, did not visit the right apartment. They visited the one on the landing opposite. The one that Cédric Jubillar was to occupy was occupied until February and therefore perfectly habitable, and the other is under construction. I can’t imagine for a moment that it was just a clumsiness, when we had sent the examining magistrate photos of the apartment. We asked that the Spip go back there but they still haven’t done so.
And they returned findings saying it was not suitable and obviously there was no internet connection needed to hook up an electronic surveillance system. When can such a mistake be made in a case of this magnitude?

Almost two years of mystery

Delphine Jubillar disappeared on the night of December 15 to 16, 2020 in Cagnac-les-Mines, a small village near Albi in the Tarn. Since then, despite significant resources deployed for the investigation, neither the body of the 33-year-old nurse nor a murder weapon have been found. Cédric, her husband, with whom she was in the process of separation, has been incarcerated since June 18, 2021, for the murder of his wife. Justice considering holding sufficiently serious and concordant elements, including the existence of an argument the evening of the disappearance of Delphine. Cédric Jubillar has been claiming his innocence since the start of the case. A reconstitution in November was announced in the press.

What do you expect from the replenishment scheduled for November?

To date, I have not been notified, I have not received a summons.

But a reenactment is planned for November 9, isn’t it?

I do not know. This is what the prosecution seems to have indicated to the press. Soon it will be the press that will summon us! It’s been like this from the start and it’s getting serious.
Either the information is false, or it is true and it is extremely serious.

What do you expect from this reconstruction?

We had asked for it a few months ago but it had been refused.
We are waiting for someone to finally explain to us what we must defend ourselves against, what we are accused of. After nearly two years of investigation, what are we really being blamed for? Cédric Jubillar will undoubtedly participate, but to the extent of the facts and gestures that were his that evening.

Could his son be present during this reconstitution?

Legally, procedurally, yes. Humanly, it would be below everything. I would find that deeply shocking. He has already been interrogated three times, it would be better to leave him alone. He has not seen his father for 16 months.

Do you keep saying the folder is empty?

It hasn’t filled up since day one. That’s why our reconstruction interests us. Since the public prosecutor’s press conference on June 18, 2021, I have the feeling that the file is being deconstructed. Nothing changes significantly.

“Bad apartment”: details from the management of the prison services of Toulouse

Following the words of Maître Alary on the apartment visited which would not be the right one, the interregional directorate of the prison services of Toulouse provides certain details: “The public prison service participates in the execution of penal decisions. It contributes to the integration or reintegration of persons entrusted to it by the judicial authority, to the prevention of recidivism and to public security with due respect the interests of society, the rights of victims and the rights of detainees. It is organized in such a way as to ensure the individualization and adjustment of sentences for convicted persons. As part of its missions, the Haute Garonne prison integration and probation service carried out an investigation into accommodation at the request of the judicial authority. This was the correct apartment and no photographic illustration was made. We assure you that a member of the owner’s family has opened the apartment for viewing.”
